Subject: Agreement to Begin Using Fleetsmarts Factoring Services
Hi [Recipient Name],
This email serves to confirm that the MC agrees to begin using Fleetsmarts for Factoring Services at the end of its current term with CF. The termination window is the period defined in the current contract in which notice of non-renewal or termination must be sent to CF to avoid auto-renewal.
MC authorizes Fleetsmarts to send the attached Notice of Termination and Non-Renewal on behalf of MC. MC also agrees to work diligently with Fleetsmarts to facilitate the switch, including procuring the Letter of Release, Aging Documents, and Buyout documents, and signing them as required by CF.
In exchange, Fleetsmarts shall open a weekly line of credit for fuel (“CL”) for MC. MC agrees to make timely payments. Failure to make timely payments according to terms may result in suspension of the CL. Suspension due to non-payment does not absolve MC of its obligations to switch factoring companies.
The value of this agreement and remedy upon breach is $5,000. Venue for any disputes is Lehi, UT.
